Lien Law

Section 34 of the Lien Law precludes waivers of lien unless payment is made concurrently with the delivery of the waiver. This section is appropriate for both private and public work.

Public Work Considerations: Section 21 of the New York State Lien Law permits the client to withhold no more than one and one-half times the amount of the lien.
